Η σύμβαση είναι πολυετής και αφορά τα οικονομικά έτη 2026 και 2027.\nΤα είδη θα παραδίδονται τμηματικά, ανάλογα με τις ανάγκες του Δήμου, σε καθορισμένες ποσότητες και με\nμονάδα μέτρησης το τεμάχιο.\nΈχοντας υπόψη:\n1. Τις διατάξεις του ν. 4412/2016 (Α΄ 147), όπως ισχύει, και ιδίως των άρθρων 2, 6, 18, 38, 53, 73, 74, 79Α,\n80, 118, 120, 200, 206, 208 και 209 αυτού.\n2. Τις διατάξεις του ν. 5314/2026 (Α΄ 103) «Κώδικας Τοπικής Αυτοδιοίκησης», όπως ισχύει μετά τον ν.\n5321/2026 (Α΄ 114), και ιδίως των άρθρων 109, 615, 616 και 619 αυτού.\n3. Τις διατάξεις του άρθρου 67 του ν. 4270/2014 (Α΄ 143), όπως ισχύει, και του π.δ. 80/2016 (Α΄ 145), όπως\nισχύει, σχετικά με τις πολυετείς υποχρεώσεις και την ανάληψη υποχρεώσεων από τους διατάκτες.\n4. Τις διατάξεις των άρθρων 14 και 15 του ν. 5218/2025 (Α΄ 125), με τις οποίες τροποποιήθηκαν τα άρθρα\n73 και 80 του ν. 4412/2016.\n5. Την υπ’ αρ. 76928/09.07.2021 Κ.Υ.Α. (Β΄ 3075), περί λειτουργίας και διαχείρισης του ΚΗΜΔΗΣ, όπως\nτροποποιήθηκε με την υπ’ αρ. 4968/22.01.2026 Κ.Υ.Α. (Β΄ 334/02.02.2026) και τη διόρθωση σφαλμάτων Β΄\n669/11.02.2026.\n6. Την υπ’ αρ. 99864/15.12.2025 εγκύκλιο του Υπουργείου Ανάπτυξης (ΑΔΑ: 6Ξ2346ΝΛΣΞ-446), σχετικά\nμε τη διενέργεια της διαδικασίας απευθείας ανάθεσης συμβάσεων προμηθειών και υπηρεσιών του άρθρου\n118 του ν. 4412/2016.\n7. Την υπ’ αριθ. 118/14-09-2026 Μελέτη του Δήμου Πρεσπών, με αρ. πρωτ. 5298/14-09-2026, συνολικής\nπροϋπολογισθείσας δαπάνης 6.260,90 € χωρίς Φ.Π.Α., ήτοι 7.763,52 € συμπεριλαμβανομένου Φ.Π.Α. 24%.\n8. Το υπ’ αρ. πρωτ. 6039/09-10-2026 τεκμηριωμένο πρωτογενές αίτημα (αριθμός αίτησης 257, ΑΔΑΜ:\n26REQ019961326).\n9.
