Unntaket er kjøring til og fra fjellstua Harvasstua, hvor ladeinfrastrukturen er begrenset. I tillegg er det satt krav til miljømerking eller tilsvarende dokumentasjon for et utvalg produkter som erfaringsmessig kan bli anskaffet som del av denne type rammeavtaler. Dette for å sikre fravær/lave nivåer av helse- og miljøfarlige stoffer og for å bidra til å redusere den samlede klima- og miljøbelastningen knyttet til anskaffelsen. Det er også satt krav til sorteringsgrad, avfallsmengde og materialgjenvinning.   Basert på de fastsatte kravsnivåene og tilgjengelig markedsinformasjon, vurderes det som lite sannsynlig at markedet kan levere produkter som i en konkurransesammenheng vil kunne dokumentere en betydelig bedre samlet klima- og miljøeffekt. På denne bakgrunn vurderes vilkårene for å benytte bestemmelsen i LOA § 5 b andre ledd tredje punktum som oppfylt. Given the requirements established to reduce the procurement’s climate and environmental impact, it is considered unlikely that there is potential for competition regarding superior climate and environmental performance that could be leveraged through award criteria.On this basis, the conditions for applying the provision in Section 5 b, second paragraph, third sentence of the Public Procurement Act (LOA) are deemed to be met.
